That both the Courts below have not assigned any reason for ignoring the documentary evidence and the admission of Chandigarh Advocates and the witness of the respondent No.1 about the complaint and the compromise got recorded from the appellant in the police station. The Trial Court has not afforded any opportunity to the Chandigarh Advocates and the appellant to lead any evidence in rebuttal to counter claim. Thus the judgments and decrees passed by the Courts below are illegal and unsustainable in the eyes of law. The Courts below have erred in finding that agreement dated 27.9.2018, 1.10.2018 and pronote dated 1.10.2018 and affidavit were not obtained under coercion in spite of the fact. The document dated 27.9.2018 itself says the same has been written in the police station on account of the complaint of Chandigarh Advocates. But this aspect of the matter has been ignored by the courts below and therefore the judgments and decrees of the Courts below are liable to be set aside.
